DISTANCE SALES AGREEMENT

ARTICLE 1 – PARTIES

1.2. BUYER (CUSTOMER)
The BUYER is the real or legal person purchasing products via www.thebulums.com. The information provided during the order process shall be taken as basis.

 

ARTICLE 2 – SUBJECT

The subject of this Agreement is to determine the rights and obligations of the parties in accordance with applicable consumer protection laws and distance selling regulations regarding the sale and delivery of the product(s) ordered electronically by the BUYER through THE BULUMS website.

 

ARTICLE 3 – PRODUCTS AND CHARACTERISTICS

3.1. Product Description:
The products subject to this Agreement consist of handmade pearl necklaces, earrings, bracelets, and natural stone designs created by THE BULUMS.

3.2. Natural Product Disclaimer:
The BUYER acknowledges that all products are handcrafted using natural pearls and semi-precious stones (such as hematite, onyx, agate, etc.). Due to the nature of these materials, slight variations in shape, texture, and color may occur. These differences are natural and shall not be considered defects.

 

ARTICLE 4 – GENERAL PROVISIONS

4.1. The BUYER confirms having read and acknowledged all essential information regarding the product’s characteristics, price, payment method, and delivery terms prior to purchase.

4.2. The product shall be delivered within the legal period of 30 days at the latest, depending on the delivery location specified by the BUYER.

4.3. THE BULUMS is responsible for delivering the product in full, in accordance with the order specifications, and in good condition.

4.4. Shipping Control:
The BUYER must check the package upon delivery. If there is visible damage, the BUYER must refuse delivery and request a damage report. THE BULUMS shall not be held liable for damages not reported at the time of delivery.

4.5. System Errors:
THE BULUMS reserves the right to cancel orders and refund payments in case of obvious pricing errors caused by system or technical issues.

 

ARTICLE 5 – RIGHT OF WITHDRAWAL, RETURN AND EXCHANGE

5.1. Hygiene and Health Restriction:
In accordance with applicable regulations, the right of withdrawal cannot be exercised for products that are not suitable for return due to hygiene reasons once their protective packaging, seal, or wrapping has been opened (including necklaces, bracelets, earrings, and similar jewelry).

Accordingly, products that have been unsealed, used, or have lost their resalable condition are not eligible for return or exchange.

All pearls and natural stones used in our designs are carefully selected and guaranteed to be authentic. Each piece is handcrafted under hygienic and controlled conditions.

In the event of any manufacturing defect, complimentary repair, exchange, or warranty support will be provided. All customer inquiries are responded to within 24 hours.

In accordance with hygiene standards and applicable regulations, products that are unused, unopened, and in resalable condition may be returned within 14 days from the date of delivery.

Similarly, products that meet hygiene requirements may be exchanged within 30 days from the date of delivery.

 

5.2. Defective or Incorrect Products:
If an incorrect product is delivered or a manufacturing defect is identified, the BUYER must notify THE BULUMS via iletisim@thebulums.com within 14 days of delivery.

After inspection, the product will be eligible for return or exchange regardless of hygiene conditions. All shipping costs in such cases will be covered by THE BULUMS.

 

5.3. Misuse:
Damage caused by exposure to perfume, creams, seawater, pool chlorine, or harsh chemicals is considered misuse and is not covered under return or exchange policies.

The BUYER agrees to store the product in its original packaging.

 

5.4. Right of Withdrawal:
Provided that the product complies with the hygiene conditions stated above, the BUYER may exercise the right of withdrawal within 14 days from the date of delivery.

Shipping costs for returns under the right of withdrawal shall be borne by the BUYER.

 

ARTICLE 6 – JURISDICTION

For disputes arising from this Agreement, Consumer Arbitration Committees and Consumer Courts at the place of residence of the BUYER or THE BULUMS shall have jurisdiction, within the limits announced by the Ministry of Trade of the Republic of Türkiye.

 

ARTICLE 7 – EFFECTIVENESS

By completing the payment for the order placed on the website, the BUYER is deemed to have accepted all terms of this Agreement.
